Terms of Use

WhichClinic operates an online comparison marketplace that helps users discover, compare and request quotes from clinics offering health-tourism treatments, primarily in Türkiye. Our role is limited to providing an information and matching platform; the clinics themselves decide whether and how to respond to your enquiry.

WhichClinic is not a healthcare provider, hospital, clinic, or intermediary in the delivery of medical services. We do not provide medical care, diagnosis, treatment, prescriptions or advice, and we establish no doctor-patient relationship between you and WhichClinic. Any consultation, treatment or care is arranged and delivered solely by the independent clinic you choose.

The clinic directory may include listings compiled from public sources (for example Google Places or OpenStreetMap) as well as listings submitted by clinics themselves. Availability of a listing does not imply any endorsement, recommendation, or verification by WhichClinic unless expressly stated.

To use the Platform, you must be at least 18 years old and have the legal capacity to enter into a binding agreement under the law applicable to you. By using the Platform, you represent and warrant that you meet these requirements.

If you use the Platform on behalf of an organisation (for example, when registering a clinic account), you represent that you are duly authorised to bind that organisation to these Terms, and references to "you" include that organisation.

• You are not barred from using the Platform under any applicable law or sanctions regime.
• You will provide accurate, current and complete information when using the Platform.
• You will comply with these Terms and all applicable laws and regulations.

Some features require an account. WhichClinic offers two types of account: patient accounts, for individuals who wish to save clinics, submit reviews and manage quote requests; and clinic accounts, for healthcare businesses that wish to be listed, upload media and documents, and receive enquiries.

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Passwords are stored only as a secure hash and are never accessible to us in plain text.

• Keep your password confidential and do not share your account with others.
• You are responsible for all activity carried out through your account.
• Notify us immediately at hello@whichclinic.net if you suspect any unauthorised use of your account.
• We may refuse, suspend or reclaim any username, and may decline to provide the service, at our reasonable discretion.

You must ensure that the registration and profile information you provide is accurate and kept up to date. We are not liable for any loss arising from your failure to safeguard your credentials.

Clinics that register or are listed on the Platform represent and warrant that they hold all licences, authorisations, registrations and permits required under Turkish law (including, where applicable, Ministry of Health requirements) and any other applicable law to lawfully provide the treatments and services they advertise.

• Listing accuracy — all information you provide (services, pricing, credentials, qualifications, photographs and documents) must be accurate, current, not misleading and kept up to date.
• Rights in content — you may upload only content you own or are authorised to use, and you must not infringe any third-party rights.
• Lawful advertising — you must comply with all rules governing the advertising and promotion of health services, including restrictions on medical claims and testimonials.
• Professional conduct — you must respond to enquiries honestly and professionally and must not make guarantees of medical outcomes.

Registered users may submit reviews and "like" clinics. Reviews must reflect your genuine, first-hand experience and must be truthful, lawful and respectful. We operate a moderation process to protect the integrity of reviews.

• Do not post false, defamatory, misleading, offensive or unlawful content.
• Do not include the personal data of other people without a lawful basis.
• Do not post content that infringes intellectual-property or other rights.
• Do not post incentivised, fake, or manipulated reviews, or reviews you were paid to write.

Moderation. We may review, moderate, decline to publish, edit for policy compliance, or remove any review or user content that breaches these Terms or our guidelines. We are under no obligation to publish or retain any content.

Licence you grant. You retain ownership of the content you submit. By submitting reviews or other content, you grant WhichClinic a worldwide, non-exclusive, royalty-free, transferable and sub-licensable licence to host, store, reproduce, adapt for display, publish, and distribute that content on and in connection with the Platform and its promotion. This licence ends when the content is removed, except for back-up copies retained for a reasonable period or as required by law.

Removal rights. You may request removal of your own review at any time via /contact. We may also remove content at our reasonable discretion, in particular where it breaches these Terms.

The Platform and all of its content — including its design, text, graphics, logos, user interface, software and the compilation and arrangement of listings — are owned by WhichClinic or its licensors and are protected by intellectual-property laws. All rights not expressly granted are reserved.

We grant you a limited, non-exclusive, non-transferable and revocable licence to access and use the Platform for your personal, non-commercial purposes in accordance with these Terms. You may not copy, reproduce, republish, scrape, frame, adapt, or create derivative works from the Platform or its content without our prior written consent, except as permitted by mandatory law.

"WhichClinic", its name, and its logos are marks of WhichClinic. Clinic names, trade marks, logos and materials belong to their respective owners and are used on the Platform only for identification and comparison purposes.

When using the Platform, you agree that you will not:

• Scrape, crawl or harvest data from the Platform by automated means, or use bots, spiders or similar tools, without our prior written permission.
• Overload, disrupt, or attack the Platform or its infrastructure, or attempt to gain unauthorised access to any system, account or data.
• Circumvent any security, access-control or rate-limiting measure.
• Engage in fraud, impersonation of any person or clinic, or misrepresentation of your identity or affiliation.
• Send spam or unsolicited communications, or misuse quote requests or contact details obtained through the Platform.
• Upload malware or any harmful code, or content that is unlawful, infringing, or violates the rights of others.
• Reverse engineer, decompile or disassemble any part of the Platform, except to the extent permitted by mandatory law.
• Use the Platform for any unlawful purpose or in any way that could damage, disable or impair it.

Clinics listed on the Platform are independent third parties. WhichClinic is not a party to, and has no involvement in, any agreement, consultation, treatment or transaction between you and a clinic. Any such relationship is solely between you and the clinic.

We make no guarantee or warranty as to the quality, safety, legality, licensing, pricing accuracy, availability, results or outcomes of any treatment, or as to the conduct of any clinic. Listings, quotes and other information are provided for general information and comparison only and may be incomplete, outdated or inaccurate; you should verify them independently.

The Platform is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted or error-free operation, to the maximum extent permitted by law.

No medical warranty. WhichClinic gives no medical or clinical warranty of any kind and is not responsible for any care, advice, diagnosis or treatment provided by a clinic. Decisions about your health are yours to make with qualified professionals.

Limitation of liability. To the maximum extent permitted by law, WhichClinic and its officers, employees and suppliers shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, or for any damages arising from treatment or services provided by a clinic. Our aggregate liability arising out of or relating to the Platform shall not exceed the amount, if any, you paid to WhichClinic for use of the Platform in the twelve months preceding the event giving rise to the claim.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under the laws of the Republic of Türkiye, including liability for death or personal injury caused by negligence, for wilful misconduct or gross negligence, or under mandatory consumer-protection law. Your mandatory statutory rights are not affected.

To the extent permitted by law, you agree to indemnify, defend and hold harmless WhichClinic and its officers, employees and agents from and against any claims, losses, liabilities, damages, costs and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of the Platform; (b) content you submit; (c) your breach of these Terms or of any applicable law or third-party right; and (d) for clinics, the services you provide or the listings you publish.

We may, at our option, assume the exclusive defence and control of any matter subject to indemnification, in which case you agree to cooperate with us. This obligation survives termination of these Terms.

We may suspend, restrict or terminate your access to the Platform, or remove any content, at any time, with or without notice, where we reasonably consider that you have breached these Terms, where required to manage a legal or security risk, or to protect the Platform, other users or third parties from harm.

You may stop using the Platform at any time and may ask us to close your account by contacting us via /contact.

Survival. Provisions that by their nature are intended to survive termination — including those on intellectual property, disclaimers, limitation of liability, indemnity and governing law — will continue to apply after your access ends.

These Terms are governed by and construed in accordance with the laws of the Republic of Türkiye, without regard to its conflict-of-law rules.

The competent courts and enforcement offices of the Republic of Türkiye shall have jurisdiction over any dispute arising out of or in connection with these Terms or the Platform. Where you use the Platform as a consumer, your mandatory statutory rights and the jurisdiction of the competent consumer arbitration committees (Tüketici Hakem Heyetleri) and consumer courts (Tüketici Mahkemeleri) are reserved.

Language. These Terms are provided in several languages for your convenience. In the event of any discrepancy or conflict, the Turkish version prevails, as Türkiye is the operative jurisdiction.

We may update these Terms from time to time to reflect changes to the Platform, our practices, or the law. When we make material changes, we will update the "last updated" date below and, where appropriate, provide further notice.

Your continued use of the Platform after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the changes, you should stop using the Platform.
